Public Agreement (Offer)

for ordering, sale and delivery of goods

This agreement is an official and public offer of the Seller to conclude a contract for the purchase and sale of Goods presented on the website gearkits.com.ua. This agreement is public, meaning that in accordance with Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers regardless of their status (individual, legal entity, private entrepreneur) without giving preference to one buyer over another.

By concluding this Agreement, the buyer fully accepts the terms and conditions of ordering, payment, delivery, returns, liability for bad faith ordering, and all other terms of the contract.

1. Definitions

• 1.1. Public Offer (hereinafter - "Offer") - a public proposal of the Seller, addressed to an indefinite circle of persons, to conclude a contract of sale of goods with the Seller remotely.
• 1.2. Product or Service – the object of the agreement, selected by the buyer on the Online Store website.
• 1.3. Online Store – Seller's website at gearkits.com.ua.
• 1.4. Buyer – a capable individual who has reached the age of 18, or a legal entity.
• 1.5. Seller – FOP IGNATUKHIN OLEKSANDR SERHIYOVYCH (ID code 3143904556).

2. Subject of the Contract

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

2.2. The date of conclusion of the Offer Agreement is considered the date the Buyer fills out the order form on the website.

3. Placing an Order

3.1. The Buyer independently places an order in the Online Store through the "Cart" form.

3.3. When placing an order, the Buyer undertakes to provide accurate information (Name, phone, delivery address).

3.8. By concluding the Agreement, the Buyer consents to the collection and processing of their personal data for order fulfillment.

4. Price and Delivery

4.1. Prices for Goods are indicated on the website in UAH (Ukrainian Hryvnia).

4.3. The cost of delivery is not included in the price of the Goods and is paid by the Buyer according to the carrier's tariffs (Nova Poshta).

4.8. Upon receipt, the Buyer is obliged to check the integrity and completeness of the Goods.

5. Rights and Obligations

5.1. The Seller is obliged to transfer goods of proper quality and not to disclose the Buyer's data.

5.3. The Buyer undertakes to provide accurate data for delivery.

6. Returns

6.1. Return of goods of proper quality is possible within 14 days, provided the goods have not been used and their marketable appearance is preserved.

6.4. Return of goods of proper quality is carried out at the Buyer's expense.

6.7. Goods made to individual order (non-standard sizes, colors) are not subject to return, except in cases of defect.

7. Liability

7.4. Parties are exempt from liability in case of force majeure circumstances (war, natural disasters).

8. Confidentiality

8.1. The Buyer provides consent to the processing of personal data in accordance with the Law of Ukraine "On Personal Data Protection".
